Terms and Conditions (T&C) regarding Smart Shoes
1.Product Description
1.1Detailed Description
The Product is thoroughly described to include all material specifications, such as its technological capabilities, sensors, connectivity features, battery life, and other key attributes. This includes, but is not limited to, functionality such as fitness tracking, mobile application connectivity, and other relevant features as disclosed by the Company.
Impakto app shall be update with time to time, which products/services may have add-on components or features, details of which are mentioned in the new updates.
Impakto is the brand of AJANTA SHOES (INDIA) PVT. LTD., Regd. Office - 79/2, A.J.C. BOSE ROAD, KOLKATA - 700 014,WEST BENGAL,INDIA.
2. Compatibility
The Product's compatibility with other devices, apps, and operating systems, including but not limited to Android and iOS platforms, is explicitly stated. The Company makes no warranty or representation regarding the Product's compatibility with devices or systems other than those expressly identified.
3. Purpose
This innovative smart shoe is designed primarily as footwear and is not classified as an electronic device. While it incorporates IoT technology to enhance user safety and provide gamified experiences, it is not intended to replace personal safety measures. Purpose of smart shoes is to integrate technology with footwear to provide enhanced functionality and benefits for users.
1. Authentication
A User may create an account on the Application by providing the requisite registration details including, the User's full name, email address, date of birth, gender, height and weight ("Registration Information"). The Company shall verify the User's email address through a mandatory email verification process and the User Account shall not be activated until such verification has been successfully completed.
As an alternative to the standard registration process, a User may register for or access the Application by authenticating through a supported third-party identity provider, including Google or Apple. Where such authentication method is used, the User authorizes the Company to obtain and process the information made available by the relevant third-party provider, subject to the User's consent and the applicable privacy policies. The use of such authentication method shall not affect the applicability of these Terms and shall result in the creation of a User Account in accordance with the registration requirements of the Application.
Upon successful registration and authentication, the User may access the Application and map the Smart Shoe with the User Account by scanning the unique Media Access Control (MAC) ID assigned to the Smart Shoe. Upon successful verification and mapping of the Smart Shoe with the User Account, the Application shall automatically generate and associate a digital electronic warranty card ("E-Warranty Card") with the registered Smart Shoe, which shall serve as the official digital record of the applicable product warranty, subject to the terms and conditions governing such warranty.
Navigation Feature
The navigation functionality made available through the Smart Shoe and the accompanying mobile application is provided on an "AS IS" and "AS AVAILABLE" basis without any warranty, representation or guarantee of uninterrupted availability, accuracy, reliability, completeness or fitness for any particular purpose.
The User acknowledges that navigation services may depend upon third-party technologies including GPS, mapping platforms, internet connectivity, mobile networks and other external services over which Impakto has no control.
The User agrees that:
1. the Navigator is intended solely as an informational and guidance tool and shall not replace the User's personal judgment or responsibility;
2. the User shall comply with all applicable traffic laws, road safety regulations, pedestrian rules and local laws while using the navigation feature;
3. the User shall remain attentive to actual road conditions, traffic signs, signals, hazards and instructions issued by the competent authorities; and
4. where there is any inconsistency between navigation instructions and actual road conditions or legal requirements, the latter shall always prevail.
To the maximum extent permitted under the applicable law, Impakto disclaims all liability for any accident, injury, death, property damage, financial loss, delay, inconvenience or other damages arising directly or indirectly from the use of, inability to use or reliance upon the Navigator, including any inaccuracies, interruptions, routing errors, software defects, GPS failures, network outages or third-party service interruptions.
The User agrees to indemnify and hold harmless Impakto, its affiliates, officers, employees, licensors, distributors and partners against any claims, liabilities, losses, damages, costs or expenses arising from the User's misuse of the navigation feature or violation of applicable laws.
Smart Gestures
The Application shall provide a Customisable Gesture Settings module through which the User may personalise the Dynamic Smart Shoe Features as follows:
1. SOS: Enable or disable the SOS feature and add, edit or remove emergency contacts to receive an SOS alert together with the User's current location.
2. Gesture Mapping: Except for the 90-degree Heel Gesture and camera which shall remain fixed, the User may assign any supported Smart Feature (including Torch, Speed Dial, Find Phone/Fake Call, Play Music and Open URL) to any compatible gesture.
3. Feature Customisation:
- Torch: Select Normal or Blink mode.
- Speed Dial: Add or edit the designated contact number.
- Find Phone/Fake Call: Configure the caller’s name and record, play, replace or delete a custom voice message using the in-app recording feature.
- Open URL:Add or edit a URL for each assigned gesture. Where multiple gestures are mapped to the Open URL feature, each gesture may be assigned a different URL.A default URL shall be provided.
4. Gesture Sensitivity: The User may configure the execution delay between gesture recognition and activation of the assigned Smart Feature.
5. AI Meeting: The Smart Shoe shall enable the User to initiate and terminate meeting audio recording through predefined gesture controls. Recorded audio files shall be stored within the application and may be processed, renamed, shared or deleted by the User. Upon processing, the integrated AI functionality shall generate a transcript of the meeting, including, where applicable, the meeting overview, discussion points with status updates, identified issues and challenges, proposed solutions, mind map, summary and an interactive query feature enabling the User to ask questions relating to the recorded meeting. The generated transcript may be exported and shared in PDF format. NOTE: The User acknowledges and agrees that the AI Meeting feature involves recording, storing, processing and transcribing audio, which may contain personal, confidential, proprietary or sensitive information, and the User shall be solely responsible for obtaining all necessary consents, permissions and authorisations and for informing all participants, wherever required by applicable law, that the meeting is being recorded and/or processed. The User shall use the feature only for lawful purposes and shall not record, process, reproduce, disclose, export or share any recording, transcript or AI-generated output in violation of any applicable law, privacy right, confidentiality obligation, contractual obligation or intellectual property right. The Company shall not be responsible for the legality, accuracy, completeness or reliability of any recording, transcript, summary, analysis, mind map, identified issue, proposed solution or other AI-generated output, and the User shall independently review and verify such content before relying upon, exporting or sharing the same. The Company shall not be liable for any loss, claim, dispute or damage arising from the User’s use or misuse of the AI Meeting feature or any AI-generated content, and the User agrees to indemnify and hold harmless the Company, its affiliates, officers, employees and service providers against any claims, liabilities, losses, damages, penalties, costs or expenses arising from the User’s unlawful or unauthorised recording, processing, use, disclosure or sharing of such content.
6. Next Song: The Smart Shoe shall enable the User, through predefined gesture controls, to skip to the next track while audio or music is being played in the background on the User's paired mobile device for android only.
7. Workout module/ Run mode
The Application shall include an AI Workout Module that automatically detects and classifies the User's activity into one of four movement states: Idle, Walking, Running and Sprinting.
- By default, the User shall remain in the Idle state, during which the shoe's rear RGB light shall continuously display a predefined animation. The animation shall automatically cease upon detection of movement.
- During a workout, the Application shall automatically identify the User's movement state and display real-time metrics, including average speed, pace, total time, distance covered and the live workout route on Google Maps using polylines.
- The Module shall continuously monitor the User's cadence for each movement state. If the User's step frequency falls below the predefined threshold for the detected state, the shoe shall provide vibration feedback to encourage an increased pace.
- Upon the User attaining a speed exceeding 6 km/h, the shoe's red LED indicator shall automatically illuminate.
- Upon completion of the workout, the Application shall generate a workout summary containing, at a minimum, the Google Maps route screenshot with recorded polylines, total workout duration, average speed, average pace, total distance, total steps, calories burned and a step-wise activity summary, including the total time and steps recorded in each movement state. The generated report may be shared through supported communication and social media platforms, including WhatsApp and email etc.
- The Module shall further include an AI Trainer with Speaker Enable/Disable functionality. When enabled, the AI Trainer shall provide voice guidance throughout the workout, including warm-up, walking, running and sprinting phases and shall deliver motivational prompts and performance-based feedback based on the User's progress.
8. Health Record
The Application shall include a Smart Health Module that provides the User with a comprehensive overview of daily activity and fitness metrics.
- The Module shall display the User's progress towards the configured daily step goal, together with the corresponding distance covered, calories burned, BMI and average pace for the selected date.
- The Module shall record and present the User's daily activity timeline, including periods of movement, duration of activity and smart shoe usage, through graphical representations.
- A Progress Overview dashboard shall display the User's activity trends on a daily, weekly, monthly and yearly basis for the selected period.
- The Module shall further provide Fitness Insights and Fitness Tips, including personalised food and workout recommendations, based on the User's recorded activity, step count, and BMI.
9. Foot Massager
- Based on the number of steps recorded by the User on a daily basis, the User shall be entitled to access the Foot Massager for a duration calculated at the rate of 10 (ten) seconds for every 100 (one hundred) steps completed during the relevant day. The access time so earned shall be subject to the applicable usage limits and system rules.
- The Foot Massager shall provide two (2) different massage modes, and the User may select either mode according to his/her preference or requirement. The total massage access time available to the User shall be divided into 30 (thirty)-second usage slots, which may be utilized by the User in accordance with the available balance of earned access time.
- The access time earned through the User's daily step count shall be calculated and made available through the applicable application/system, and the User may utilize such available time at his/her discretion, subject to the availability and operational functionality of the Foot Massager.
4. User Responsibilities
4.1 Proper Use
The smart shoes are designed to be charged with an input voltage of 5V-9V DC & Current .5A – 2A, a standard voltage commonly used for small electronic devices. Any deviation from the specified voltage or use of unauthorized chargers may result in damage to the device and void the warranty. The manufacturer is not responsible for any issues arising from improper charging practices.
Washing smart shoes requires special care to protect the electronic components. To ensure proper maintenance and avoid damage, adhere to the following guidelines:
4.1.1 Do Not Submerge in Water: The Shoes are splashproof and dustproof, but not waterproof, and shall not be submerged, immersed, or exposed to excessive or prolonged contact with water, as such exposure may damage the electronic components and affect the functionality of the Shoes.
4.1.2 Spot Clean Only: Use a damp cloth or soft brush with mild soap to gently clean the surface of the shoes. Excessive water or pressure should be avoided.
4.1.3 Avoid Harsh Chemicals: Do not use bleach, strong detergents, or abrasive cleaners, as these can harm the materials and internal components.
4.1.4 Air Dry Naturally: Allow the shoes to air dry in a cool, shaded area. Do not use direct heat sources such as hairdryers, radiators, or other devices to speed up the drying process.
4.1.5 Legal Safety Disclaimer: Failure to follow these cleaning instructions may result in damage to the product or compromise its functionality. The manufacturer disclaims any responsibility for damage caused by improper cleaning methods or non-compliance with these guidelines.
5.CUSTOMER RESPONSIBILITY
5.1 You are required to report the problem to Imapkto email id (info@impakto.in), WhatsApp and call (+91 6293693196) within 48 hours of discovering the issue.
5.2 It is your responsibility to properly maintain, wash and use your item according to the manufacturer instructions and take all reasonable steps to use your equipment as prescribed by the manufacturer.
5.3 You agree to return the defective spares or product to Impakto ’s personnel from the place of repair of the product. In all such cases, Impakto shall pick up the defective spares/ product (in case of total loss).
5.4 Customer shall register all complaints/requests for Services only through official website, WhatsApp No. and Call.
5.5 Customer shall comply with all applicable laws, rules and regulations.
5.6 Any written communication, billing statement or notice from Impakto to Customer will be deemed as served within 48 hours of posting by ordinary mail or earlier as the case may be.
5.7 Customer agrees that it shall be its responsibility to be aware of the Contract and the changes therein. Ignorance if any shall be the total responsibility of the Customer.
5.8 Customer shall not assign any right or interest or delegate any obligation arising herein to any person without Imapkto's prior written consent.
6.Restrictions
The Product must not be subjected to misuse, including but not limited to, immersion in water, exposure to extreme temperatures, or any conditions that may cause undue damage. Any such use shall be deemed a violation of the terms and shall invalidate any claims under the warranty.
6.1 Unauthorized Modifications
The User acknowledges and agrees that any unauthorized repairs, alterations, or modifications made to the Product shall immediately void the warranty and release the Company from any further liability.
6.2 SERVICING OF CLAIMS
The Customer acknowledges and understands that claim or payment of any benefit covered by an add-on extended warranty cover shall be governed by the Plan Terms and Imapkto shall be liable to provide the services to the Customer in accordance with the Plan Term and facilitation the same with Imapkto and/ or its Insurer.
Any claims made by the Customer under these Terms and Plan Terms shall be subject to the following:
The Customer having met and complied with the Terms and the Plan Terms (as applicable). This also applies to terms and conditions set out herein;
- The Customer having provided Imapkto with full and accurate information in connection with the coverage, as applicable;
- The Customer having complied with the requirements of processing the claim may be required from time to time:
- Claim related details duly filled by the Customer; and
- Invoice copy
- -Any Govt issued identity proof to confirm Name, Address and Date of Birth
- Bank Account details, cancelled Cheque in case of monetary settlement
7. Intellectual Property
7.1 Ownership of Intellectual Property
All intellectual property rights, including but not limited to software, firmware, trademarks, patents, and proprietary technologies associated with the Product, remain the exclusive property of the Company. No transfer of ownership of intellectual property is conferred upon the User by the purchase or use of the Product.
8.Privacy and Data Collection
Privacy Policy – Collection and Use of Location Data
To provide navigation functionality, the Smart Shoe application may collect, process and use the User's precise or approximate location information, subject to the permissions granted by the User on the mobile device.
Location information is used solely for purposes including:
- providing navigation and route guidance;
- enabling location-based services and related features;
- improving navigation accuracy and user experience;
- diagnosing technical issues and enhancing application performance; and
- complying with applicable legal and regulatory obligations.
The User may withdraw or modify location permissions through the device settings at any time. However, disabling location access may limit or prevent the proper functioning of the navigation feature.
The provision of navigation services may involve third-party mapping, GPS, geolocation or cloud service providers. Such third parties may process location information in accordance with their respective privacy policies. Impakto does not control the practices of such third-party providers and encourages Users to review their applicable privacy policies.
While Impakto implements reasonable technical and organizational safeguards to protect personal information, no electronic transmission, GPS service or internet-based communication can be guaranteed to be completely secure, uninterrupted or error-free.
Collection and processing of location data shall not be construed as a representation or warranty that the navigation information, routes or directions provided will always be accurate, complete, safe, or suitable for every circumstances. The User remains solely responsible for complying with all applicable traffic laws, road safety regulations and local laws while using the navigation feature
9.Confidentiality
The Company shall not share any collected personal data with third parties without the User’s explicit consent, except as necessary to provide services, comply with legal obligations, or fulfil operational needs. Users will be notified of any such data sharing and will have the opportunity to provide or withhold consent.
10. Liability Limitations
Limitation of Liability
The Company’s liability, whether in contract, tort, or otherwise, is strictly limited to the amount paid for the Product, and the Company shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to, loss of profits, data, or goodwill, arising out of the use or misuse of the Product. This limitation of liability applies to all claims, including those involving negligence, warranty breaches, or third-party services.
11. Return and Refund Policy
11.1 Refund Process
The Company shall process refunds in accordance with the condition of the returned Product and subject to receipt of proof of purchase. Refunds will be credited to the original payment method used for the purchase, within a reasonable period after the return has been approved.
11.2 Consumer Rights
In accordance with the Consumer Protection Act, 2019, the Company offers a return and refund policy that allows the User to return the Product under specified conditions, such as defects, damages, or non-conformance to advertised specifications. Returns must be initiated within 15 to 30 days of the purchase date.

12. Third-party Services
The Product may integrate with or interact with third-party applications or services, including Spotify, JioSaavn, or similar music-streaming applications, for functions such as skipping or proceeding to the next track/song. The Company shall not be responsible or liable for the availability, functionality, compatibility, interruption, or performance of any such third-party application or service, and the User shall use such services subject to the respective third party’s terms and conditions.
13. Dispute Resolution
Governing Law and Jurisdiction
This Agreement shall be governed by, and construed in accordance with, the laws of India, without regard to its conflict of law principles. Any disputes arising from this Agreement shall be subject to the exclusive jurisdiction of the courts located in Kolkata, India.
14. Arbitration
In the event of a dispute, the parties agree to resolve the matter through arbitration, conducted in accordance with the provisions of the Arbitration and Conciliation Act, 1996. The arbitration shall take place in Kolkata, India and the proceedings shall be conducted in English.
15. Warranty
15.1 Duration of Warranty
The Company offers a warranty period of shoes 15 days and Electronic Device for next 180 days from the date of purchase, unless otherwise specified. This warranty is provided in compliance with the Consumer Protection Act, 2019, and applies exclusively to products purchased in India.
15.2 Scope of Warranty
The warranty covers defects in materials and workmanship, including malfunctions in sensors, battery, and connectivity components. It also covers software defects that prevent the proper functioning of the Product.
15.3 Exclusions
The warranty does not cover:
- Damage resulting from misuse, accidents, or neglect.
- Wear and tear from normal usage.
- Unauthorized repairs or modifications.
- Damage arising from improper maintenance or failure to adhere to care instructions provided by the Company.
- Damage caused by unauthorized repair, theft, burglary and accident including earthquake, storm and or hurricane, abuse, misuse, sand, dust, water, negligence, fire, flood, lightning leading to fire, malicious damage, impact, corrosion, battery leakage, acts of God, animal or insect infestation, voltage surge or intrusion.
16. Process for Claims
To file a warranty claim, the User must contact customer support 1800 202 4950, WhatsApp No. +91 6293693196, Email: info@impakto.in and provide proof of purchase. The defective Product must be returned according to the Company’s instructions, and the Company will repair as applicable.
17. Repair/Replacement/Refund
The Company will determine whether the Product will be repaired, replaced, or refunded based on the nature of the defect, in accordance with the Company’s warranty policy. Claims will be addressed within a reasonable timeframe, typically within 30 days, in compliance with applicable consumer protection laws.
18. Transferability
The warranty is [non-transferable/transferable], applying exclusively to the original purchaser of the Product, unless otherwise specified by the Company.
19. Legal Compliance
19.1 Consumer Protection Act, 2019
Under the Consumer Protection Act, 2019, the User is entitled to a warranty for the quality, performance, and safety of the Product. If the Product is found defective or fails to meet promised specifications, the User is entitled to a remedy, including repair, replacement, or refund.
19.2 Consumer Rights
This warranty is in addition to, and does not affect, the statutory rights of the consumer under the Consumer Protection Act, 2019, including the right to repair, replacement, or refund for defective products.
19.3 E-commerce Rules
In the event the Product is sold online, the Company agrees to comply with the Consumer Protection (E-commerce) Rules, 2020, ensuring that the User has access to clear product information, return policies, and grievance redressal mechanisms.
19.4 Product Liability and Safety
The Company ensures that the Product complies with all applicable safety standards in India, including those established by the Bureau of Indian Standards (BIS), where relevant. The Company may be held liable under the Product Liability Act if the Product defectively causes harm or damage.
19.5 Data Protection Compliance
The Company adheres to India’s data protection framework, including the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011, and any forthcoming personal data protection legislation. This ensures that the Company responsibly handles, processes, and shares consumer data in compliance with Indian data privacy laws.
20. General Definitions:
- "Device” shall mean the Electronic Component of the Shoes.
- Normal Operating Condition: Ability of the product to perform its specified function subject to the acceptable level of change in performance due to ageing or climatic conditions. The acceptable level of change for this purpose will be as per the respective Manufacturer’s specifications.
- Normal use: Use of the product in accordance with the Manufacturer’s guidelines for Product usages including but not limited to regular maintenance and upkeep of the Product, usage of specified protection device such as voltage stabilizer.
- Mechanical/ Electrical Breakdown: Means defect, the breaking or burning out (electrical) of any defined parts of the covered product arising from mechanical or electrical defect causing sudden stoppage of their functions, necessitating visit, repair or replacement.
- Covered Breakdown: Breakdown covered during the manufacturer’s warranty/ guarantee period. The covered breakdown will vary for each product in accordance with the manufacturer’s warranty/guarantee for the said period.
- Manufacturer’s Warranty/ Guarantee: The original warranty/ guarantee provided by the respective manufacturer to the respective product as per manufacturer’s warranty/ guarantee terms & conditions.
- Manufacturer’s Warranty/ Guarantee period: The uninterrupted period of the manufacturer’s warranty/ guarantee cover as stated on the original official manufacturer’s warranty/ guarantee certificate and publications.
Electronic Data” means facts, concepts and information converted to a form useable for communications, interpretation or processing by electronic and electromechanical data processing or electronically controlled equipment and includes programmes, software and other coded instructions for the processing and manipulation of data or the direction and manipulation of such equipment.
21. MISCELLANEOUS
The marketing brochures are meant purely for educating customers about the features and terms of Extended Warranty and they have no commercial value.
This Agreement is the complete and exclusive agreement between issuer of Extended Warranty i.e. [www.impakto.in](http://www.impakto.in/) and Customer relating to the subject matter hereof. Any statements or representations made by resellers, ASPs or others that are inconsistent with this Agreement shall not be binding upon us.
22\. To obtain service for your smart shoes, please follow the steps outlined below:
22.1 Contact Customer Support:
- Visit the official Imapkto website at impakto.in.
- Reach out to customer support via the provided contact number or WhatsApp through the website portal and raise your concern.
22.2 Warranty & Repair Policies:
- If your smart shoes are covered under warranty, you may be eligible for a free repair or replacement as per the company's warranty terms.
- If the issue can be resolved remotely, the customer support team will provide guidance accordingly.
- For software-related problems, update the Impakto app, available on the Play Store.
22.3 Physical Repair Process
- If the issue cannot be resolved remotely, the customer is required to courier the shoes to the registered office at their own cost.
- Shoes should be neat & clean from customer end.
- In case of warranty clause is not violet, after repair the company will ship the shoes back to the customer.
