Terms and Conditions (T&C) regarding Smart Shoes

1.Product Description

1.1Detailed Description

The Product is thoroughly described to include all material specifications, such as its technological capabilities, sensors, connectivity features, battery life, and other key attributes. This includes, but is not limited to, functionality such as fitness tracking, mobile application connectivity, and other relevant features as disclosed by the Company.

Impakto app shall be update with time to time, which products/services may have add-on components or features, details of which are mentioned in the new updates. 

Impakto* is the brand of AJANTA SHOES (INDIA) PVT. LTD., Regd. Office - 79/2, A.J.C. BOSE ROAD, KOLKATA - 700 014,WEST BENGAL,INDIA.


2. Compatibility

The Product's compatibility with other devices, apps, and operating systems, including but not limited to Android and iOS platforms, is explicitly stated. The Company makes no warranty or representation regarding the Product's compatibility with devices or systems other than those expressly identified.

3. Purpose

This innovative smart shoe is designed primarily as footwear and is not classified as an electronic device. While it incorporates IoT technology to enhance user safety and provide gamified experiences, it is not intended to replace personal safety measures. Purpose of smart shoes is to integrate technology with footwear to provide enhanced functionality and benefits for users. While these smart shoes are designed to offer features such as:

3.1 Health and Fitness Monitoring: Tracking metrics like steps, distance, calories burned, and posture to support health and fitness goals.

3.2 Gamified Experiences: Adding interactive elements to encourage activity, such as rewards for reaching milestones or engaging in fitness challenges.

3.3 Customization and Comfort: Using data to recommend or adjust shoe fit and performance settings for optimal comfort and support.

3.4 Lifestyle Integration: Time to time update new features like smartphone connectivity for notifications, music control, or seamless integration with daily routines.


4. User Responsibilities

4.1 Proper Use

The smart shoes are designed to be charged with an input voltage of 5V-9V DC & Current .5A – 2A, a standard voltage commonly used for small electronic devices. Any deviation from the specified voltage or use of unauthorized chargers may result in damage to the device and void the warranty. The manufacturer is not responsible for any issues arising from improper charging practices.

Washing smart shoes requires special care to protect the electronic components. To ensure proper maintenance and avoid damage, adhere to the following guidelines:

4.1.1 Do Not Submerge in Water: Avoid fully immersing the shoes in water, as this can damage the electronic components.

4.1.2 Spot Clean Only: Use a damp cloth or soft brush with mild soap to gently clean the surface of the shoes. Excessive water or pressure should be avoided.

4.1.3 Avoid Harsh Chemicals: Do not use bleach, strong detergents, or abrasive cleaners, as these can harm the materials and internal components.

4.1.4 Air Dry Naturally: Allow the shoes to air dry in a cool, shaded area. Do not use direct heat sources such as hairdryers, radiators, or other devices to speed up the drying process.

4.1.5 Legal Safety Disclaimer: Failure to follow these cleaning instructions may result in damage to the product or compromise its functionality. The manufacturer disclaims any responsibility for damage caused by improper cleaning methods or non-compliance with these guidelines.


5.CUSTOMER RESPONSIBILITY

5.1 You are required to report the problem to Imapkto* email id (info@impakto.in), whatsapp (+91 6289616611) within 48 hours of discovering the issue.

5.2 It is your responsibility to properly maintain, wash and use your item according to the manufacturer instructions and take all reasonable steps to use your equipment as prescribed by the manufacturer.

5.3 You agree to return the defective spares or product to Impakto ’s personnel from the place of repair of the product. In all such cases, Impakto* shall pick up the defective spares/ product (in case of total loss).

5.4 Customer shall register all complaints/requests for Services only through official website or WhatsApp No. and Tollfree Support. 

5.5 Customer shall comply with all applicable laws, rules and regulations.

5.6 Any written communication, billing statement or notice from Impakto* to Customer will be deemed as served within 48 hours of posting by ordinary mail or earlier as the case may be.

5.7 Customer agrees that it shall be its responsibility to be aware of the Contract and the changes therein. Ignorance if any shall be the total responsibility of the Customer.

5.8 Customer shall not assign any right or interest or delegate any obligation arising herein to any person without Imapkto* 's prior written consent.

6.Restrictions

The Product must not be subjected to misuse, including but not limited to, immersion in water, exposure to extreme temperatures, or any conditions that may cause undue damage. Any such use shall be deemed a violation of the terms and shall invalidate any claims under the warranty.

6.1 Unauthorized Modifications

The User acknowledges and agrees that any unauthorized repairs, alterations, or modifications made to the Product shall immediately void the warranty and release the Company from any further liability.

6.2 SERVICING OF CLAIMS

The Customer acknowledges and understands that claim or payment of any benefit covered by an add-on extended warranty cover shall be governed by the Plan Terms and Imapkto* shall be liable to provide the services to the Customer in accordance with the Plan Term and facilitation the same with Imapkto* and/ or its Insurer.

Any claims made by the Customer under these Terms and Plan Terms shall be subject to the following:

The Customer having met and complied with the Terms and the Plan Terms (as applicable). This also applies to terms and conditions set out herein;

  • The Customer having provided Imapkto* with full and accurate information in connection with the coverage, as applicable;
  • The Customer having complied with the requirements of processing the claim may be required from time to time:
  • Claim related details duly filled by the Customer; and
  • Invoice copy
  • -Any Govt issued identity proof to confirm Name, Address and Date of Birth
  • Bank Account details, cancelled Cheque in case of monetary settlement

7. Intellectual Property

7.1 Ownership of Intellectual Property


All intellectual property rights, including but not limited to software, firmware, trademarks, patents, and proprietary technologies associated with the Product, remain the exclusive property of the Company. No transfer of ownership of intellectual property is conferred upon the User by the purchase or use of the Product.

8.Privacy and Data Collection

8.1 Personal Data Usage

The Product may collect personal data, such as health information, GPS data, and usage statistics, to enhance functionality and user experience. The Company will collect, store, and process such data in accordance with applicable data privacy laws, including the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011, under the Information Technology Act, 2000. By using the Product, the User consents to the collection and use of their personal data in line with the Company’s privacy policy.


9.Confidentiality 

The Company shall not share any collected personal data with third parties without the User’s explicit consent, except as necessary to provide services, comply with legal obligations, or fulfil operational needs. Users will be notified of any such data sharing and will have the opportunity to provide or withhold consent.

10. Liability Limitations

 Limitation of Liability

The Company’s liability, whether in contract, tort, or otherwise, is strictly limited to the amount paid for the Product, and the Company shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to, loss of profits, data, or goodwill, arising out of the use or misuse of the Product. This limitation of liability applies to all claims, including those involving negligence, warranty breaches, or third-party services.


11. Return and Refund Policy

11.1 Refund Process

The Company shall process refunds in accordance with the condition of the returned Product and subject to receipt of proof of purchase. Refunds will be credited to the original payment method used for the purchase, within a reasonable period after the return has been approved.

11.2 Consumer Rights

In accordance with the Consumer Protection Act, 2019, the Company offers a return and refund policy that allows the User to return the Product under specified conditions, such as defects, damages, or non-conformance to advertised specifications. Returns must be initiated within 15 to 30 days of the purchase date.

In accordance with Section 15 and Section 19 of the Consumer Protection Act, 2019, the Company offers a return and refund policy that allows the User to return the Product under specified conditions, such as defects, damages, or non-conformance to advertised specifications. As per Section 18 of the Act, the Product must meet the expected quality and performance standards, and if it fails to do so, the User has the right to seek a remedy. Returns must be initiated within 15 to 30 days of the purchase date, as per the guidelines set out in Section 21 of the Act, which ensures consumers have access to redressal mechanisms.

12. Third-party Services

 App/Service Integration

The Product may integrate with third-party applications or services. The Company disclaims any and all liability for issues arising from the use of third-party services, and the User agrees to hold the Company harmless from any claims related to third-party apps, their availability, or their functionality.

13. Dispute Resolution

Governing Law and Jurisdiction

This Agreement shall be governed by, and construed in accordance with, the laws of India, without regard to its conflict of law principles. Any disputes arising from this Agreement shall be subject to the exclusive jurisdiction of the courts located in Kolkata, India.

14. Arbitration

In the event of a dispute, the parties agree to resolve the matter through arbitration, conducted in accordance with the provisions of the Arbitration and Conciliation Act, 1996. The arbitration shall take place in Kolkata, India and the proceedings shall be conducted in English.


15. Warranty

15.1 Duration of Warranty

The Company offers a warranty period of shoes 15 days and Electronic Device for next 180 days from the date of purchase, unless otherwise specified. This warranty is provided in compliance with the Consumer Protection Act, 2019, and applies exclusively to products purchased in India.

15.2 Scope of Warranty

The warranty covers defects in materials and workmanship, including malfunctions in sensors, battery, and connectivity components. It also covers software defects that prevent the proper functioning of the Product.

15.3  Exclusions
The warranty does not cover:

  • Damage resulting from misuse, accidents, or neglect.

  • Wear and tear from normal usage.

  • Unauthorized repairs or modifications.

  • Damage arising from improper maintenance or failure to adhere to care instructions provided by the Company.

  • Damage caused by unauthorized repair, theft, burglary and accident including earthquake, storm and or hurricane, abuse, misuse, sand, dust, water, negligence, fire, flood, lightning leading to fire, malicious damage, impact, corrosion, battery leakage, acts of God, animal or insect infestation, voltage surge or intrusion.

16. Process for Claims

To file a warranty claim, the User must contact customer support 1800 202 4950, WhatsApp No. 9748431818, Email: info@impakto.in and provide proof of purchase. The defective Product must be returned according to the Company’s instructions, and the Company will repair as applicable. 

17. Repair/Replacement/Refund

The Company will determine whether the Product will be repaired, replaced, or refunded based on the nature of the defect, in accordance with the Company’s warranty policy. Claims will be addressed within a reasonable timeframe, typically within 30 days, in compliance with applicable consumer protection laws.

18. Transferability

The warranty is [non-transferable/transferable], applying exclusively to the original purchaser of the Product, unless otherwise specified by the Company.

19. Legal Compliance

19.1 Consumer Protection Act, 2019

Under the Consumer Protection Act, 2019, the User is entitled to a warranty for the quality, performance, and safety of the Product. If the Product is found defective or fails to meet promised specifications, the User is entitled to a remedy, including repair, replacement, or refund.

19.2 Consumer Rights

This warranty is in addition to, and does not affect, the statutory rights of the consumer under the Consumer Protection Act, 2019, including the right to repair, replacement, or refund for defective products.


19.3 E-commerce Rules

In the event the Product is sold online, the Company agrees to comply with the Consumer Protection (E-commerce) Rules, 2020, ensuring that the User has access to clear product information, return policies, and grievance redressal mechanisms.

19.4 Product Liability and Safety

The Company ensures that the Product complies with all applicable safety standards in India, including those established by the Bureau of Indian Standards (BIS), where relevant. The Company may be held liable under the Product Liability Act if the Product defectively causes harm or damage.

19.5 Data Protection Compliance

The Company adheres to India’s data protection framework, including the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011, and any forthcoming personal data protection legislation. This ensures that the Company responsibly handles, processes, and shares consumer data in compliance with Indian data privacy laws.

20. General Definitions:

  • "Device” shall mean the Electronic Component of the Shoes.
  • Normal Operating Condition: Ability of the product to perform its specified function subject to the acceptable level of change in performance due to ageing or climatic conditions. The acceptable level of change for this purpose will be as per the respective Manufacturer’s specifications.
  • Normal use: Use of the product in accordance with the Manufacturer’s guidelines for Product usages including but not limited to regular maintenance and upkeep of the Product, usage of specified protection device such as voltage stabilizer.
  • Mechanical/ Electrical Breakdown: Means defect, the breaking or burning out (electrical) of any defined parts of the covered product arising from mechanical or electrical defect causing sudden stoppage of their functions, necessitating visit, repair or replacement.
  • Covered Breakdown: Breakdown covered during the manufacturer’s warranty/ guarantee period. The covered breakdown will vary for each product in accordance with the manufacturer’s warranty/guarantee for the said period.
  • Manufacturer’s Warranty/ Guarantee: The original warranty/ guarantee provided by the respective manufacturer to the respective product as per manufacturer’s warranty/ guarantee terms & conditions.
  • Manufacturer’s Warranty/ Guarantee period: The uninterrupted period of the manufacturer’s warranty/ guarantee cover as stated on the original official manufacturer’s warranty/ guarantee certificate and publications.

  • Electronic Data” means facts, concepts and information converted to a form useable for communications, interpretation or processing by electronic and electromechanical data processing or electronically controlled equipment and includes programmes, software and other coded instructions for the processing and manipulation of data or the direction and manipulation of such equipment.

21. MISCELLANEOUS

The marketing brochures are meant purely for educating customers about the features and terms of Extended Warranty and they have no commercial value.

This Agreement is the complete and exclusive agreement between issuer of Extended Warranty i.e. www.impakto.in and Customer relating to the subject matter hereof. Any statements or representations made by resellers, ASPs or others that are inconsistent with this Agreement shall not be binding upon us.

22. To obtain service for your smart shoes, please follow the steps outlined below:

22.1 Contact Customer Support:

  • Visit the official Imapkto* website at impakto.in.

  • Reach out to customer support via the provided contact number or WhatsApp through the website portal and raise your concern.

22.2 Warranty & Repair Policies:

  • If your smart shoes are covered under warranty, you may be eligible for a free repair or replacement as per the company's warranty terms.

  • If the issue can be resolved remotely, the customer support team will provide guidance accordingly.

  • For software-related problems, update the Impakto app, available on the Play Store.

22.3 Physical Repair Process

  • If the issue cannot be resolved remotely, the customer is required to courier the shoes to the registered office at their own cost.

  • Shoes should be neat & clean from customer end.

  • In case of warranty clause is not violet, after repair the company will ship the shoes back to the customer.
