[Impakto Smart Shoes Navigator ] License Agreement 

This Licence Agreement ("Agreement") is a legal agreement between you ("User" or"You") and Impakto Sports Private ltd ("Company" or "We") for the use of Impakto SmartShoes Navigator  ("App"), including any associated documentation and updates provided by the Company. 

By downloading, installing, or using the App, you agree to be bound by the terms and conditions of this Agreement. If you do not agree to the terms of this Agreement, do not download, install, or use the App. 

  1. Licence Grant 

Subject to the terms and conditions of this Agreement, the Company grants you a limited, non-exclusive, non-transferable, and revocable license to use the App for your personal or internal business purposes. 

  1. Restrictions 

You may not: 

  • Modify, adapt, translate,reverse engineer, decompile, or disassemble the App. ● Create derivative works based on the App. 
  • Remove, alter, or obscure any copyright, trademark, or other proprietary notices from the App. 
  • Use the App for any unlawful or unauthorised purpose. 
  1. Intellectual Property 

The App, including all associated intellectual property rights, is and shall remain the exclusive  property of the Company. Nothing in this Agreement shall be construed to transfer any ownership rights to you. 

  1. Personal Information 

Location Data: When you use our app in conjunction with your smart shoes, we may collect  and process information about your real-time location. This is essential for functionalities  such as route tracking and navigation. We use technologies such as GPS and other sensors  to determine location. 

Smart Shoe Data: We collect data from your smart shoes, including movement data, step  count, and other activity metrics. 

Usage Data: We collect information about how you interact with our app and smart shoes,  including usage patterns and preferences.

How We Use Your Information 

To Provide Services: We use the information collected to deliver and improve our services,  including providing location-based services through Google Maps, tracking your activity, and  enhancing your overall experience with our smart shoes. 

Location-Based Services: 

Your location data is used to provide functionalities such as navigation, route tracking, and  finding nearby places of interest. 

Google Maps Privacy and Security 

Google Maps API:

Security of Your Information 

We implement appropriate technical and organizational measures to safeguard your  personal information against accidental or unlawful destruction, loss, alteration,  unauthorized disclosure, or access.

You have the right to access, update, correct, or delete your personal information. You can  manage your data within the app settings or by contacting us directly. 

Changes to This Privacy Policy 

We may update this Privacy Policy from time to time. Any changes will be posted on this  page, and we will update the "Last updated" date at the top of this policy. 

  1. Warranty Disclaimer 

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

  1. Limitation of Liability 

IN NO EVENT SHALL THE COMPANY BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH THE USE OR PERFORMANCE OF THE APP. 

  1. Termination 

The Company may terminate this Agreement at any time without notice if you breachany  provision of this Agreement. Upon termination, you must cease all use of the App and destroy all copies of the App in your possession or control. 

  1. Governing Law 

This Agreementshall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. 

  1. Entire Agreement 

This Agreement constitutes the entire agreement between you and the Company regarding the subject matter hereof and supersedes all prior or contemporaneous agreements, representations, warranties, and understandings, whether written ororal. 

By downloading, installing, or using the App, you acknowledge that you have read, understood, and agree to be bound by the terms and conditions of this Agreement.
